Terms of Service
Draft for review. This document is still being reviewed and may change before it becomes final.
These Terms are an agreement between you and Maoz Chonowitz (“Rival”, “we”, “us”). They apply when you use the Rival website and service. By creating an account or using Rival you agree to them. If you do not agree, do not use Rival.
1. The short version
- Rival is a game with virtual money. Virtual balances are not real money and can never be cashed out. The only real prizes are those offered under a tournament’s Official Rules.
- Rival is not a broker. It does not buy real securities, does not hold or invest anyone’s money, does not place real trades and does not give investment advice. That includes Rival AI.
- Play fair: no bots, no collusion or manipulation, no exploiting bugs, and no offensive names or photos. You may have more than one Rival account; each account is a separate entry.
- Our calculations of prices, values, returns and rankings are the official record of every game.
2. Who can use Rival
You must be at least 18 years old and able to form a binding contract where you live. You may have more than one Rival account. Each account is separate: its own entry, portfolio and ranking, and, once subscriptions begin, its own subscription. The information you give us must be accurate. Do not use Rival where doing so would break the law.
3. Virtual money, not real money
Every portfolio starts with $100,000 of virtual money. Virtual money, portfolios, ranks and results have no monetary value of their own. They cannot be bought, sold, transferred, withdrawn or exchanged for money or anything else. A prize is only ever offered under separate Official Rules for a specific tournament, which may award it based on final standings, and it is paid by Rival, never out of virtual balances. Virtual balances are never funded with real money. Rival does not hold money, securities, funds or crypto assets for you, and you do not own any real investment through Rival.
Prices and subscriptions. Some features, tournaments or subscriptions may have a price. A price applies only where it is clearly shown before you choose to pay, together with any terms that apply to it. If a tournament has an entry fee, its Official Rules say so. Where a subscription applies, it is per account, you can cancel it at any time, and its price, billing and renewal terms are shown before you subscribe. A tournament’s Official Rules say whether access to it or eligibility for its prize requires a subscription.
4. Not investment advice
Rival is for entertainment and education. Nothing on Rival is financial, investment, tax or legal advice, or a recommendation to buy, sell or hold any security or crypto asset. This includes the investments other players hold, leaderboards, Rival AI’s choices and any explanation of them. Results in a simulation do not predict real results. Real investing involves risk, including the loss of money. Consider getting advice from a licensed professional before making real financial decisions.
5. Market data and how games are calculated
Rival uses market data from third-party providers. In tournaments that execute at current prices, a confirmed change is traded at a current market price obtained at that moment, only while the US regular session is open, and portfolio values and standings follow current prices during the session, refreshed about every five minutes. Official closing prices are recorded after every close and decide final results, as described in How Rival works. Starting portfolios, and tournaments created before current-price execution was introduced, execute at official closing prices. Prices come from third parties and may be delayed, missing or wrong. When no valid current price is available, a change is not executed, and when data is missing Rival waits for confirmed data instead of guessing.
Rival’s own records of executions, cash, values, returns and rankings are the official result of every game. If we find an error in data or in our calculations, we may correct it, including after results were shown. Completed tournaments are normally frozen. We may still correct or void a result affected by a clear error, a technical failure or a breach of these Terms. Market data remains the property of its providers. You may not copy or redistribute it from Rival.
6. Tournaments
Each tournament’s game rules are fixed when it is created: start and end dates, how often portfolios can change, and the available investments. You must verify your email address before you join or create a tournament, challenge Rival AI or submit a portfolio. Friends tournaments are created by players. Anyone with the invite link can join before the starting cutoff. In You vs Rival AI, you play one-on-one against Rival AI. Official tournaments are run by Rival. Ties share a rank. If a data or technical failure makes fair completion impossible, we may pause, extend, cancel or void a tournament.
Official Rules and prizes. Not every tournament has a prize. Only an Official tournament can have one, and only when its own Official Rules, linked from that tournament, say so. Those rules also set its eligibility, dates and any entry terms. Rival may correct an Official tournament’s prize description and rules link until the tournament starts; after that they are fixed. For such a tournament, its Official Rules apply together with these Terms; if they conflict, the Official Rules apply to that tournament. Prizes go only to eligible human players who follow these Terms and the Official Rules.
7. Rival AI
Rival AI is an automated competitor powered by a third-party AI model. It plays by the same tournament rules and uses the same prices as everyone else, but it is never eligible for a prize. It can make poor choices, fail to act or stop taking part, for example when its provider is unavailable. Its choices are part of a game and are not advice. In Friends tournaments, members can see Rival AI’s executed holdings, as they can for any player. In You vs Rival AI, you choose when you start whether you see its executed holdings during play or only when the tournament ends. In Official tournaments its holdings stay hidden until the tournament ends.
8. Your account
Keep your password secret. If you sign in with Google, keep your Google account secure, because anyone who can use it can sign in to your Rival account. Tell us at support@rival100k.com if you think someone else is using your account. You are responsible for activity on your account. You can delete your account yourself at any time in Account, as described in the Privacy Policy.
9. Your content: names, photos and tournament names
You own the display name, profile photo and tournament names you add (“your content”). You give Rival a worldwide, non-exclusive, royalty-free licence to host, store, resize and display your content to other players, only to run and promote the Rival service, until your content is deleted.
You must have the right to use your content. It must not be illegal, hateful, harassing, sexual, violent, deceptive or infringing, and it must not impersonate anyone, include someone else’s personal information without permission, or advertise. Only upload a photo of yourself or an image you have the rights to. We may remove content or rename tournaments that break these rules, without notice. Report content to support@rival100k.com.
10. Fair play
You agree not to:
- use other people’s accounts, or use several accounts or players together to collude, manipulate rankings or standings, or otherwise gain an unfair advantage;
- use bots, scripts, scraping or automated access, except through features Rival provides;
- exploit bugs, data errors or timing issues, or interfere with the service, its security or other players;
- try to access holdings, pending changes or data you are not allowed to see;
- harass, threaten or deceive other players; or
- copy, resell or commercially exploit Rival or its data.
Please report bugs to support@rival100k.com instead of using them. We may reset results, remove players from tournaments, or suspend or close accounts that break these Terms.
11. Rival’s service and intellectual property
Rival, the Rival name, logo and design, and the software are owned by Maoz Chonowitz or its licensors. We give you a personal, revocable, non-transferable right to use Rival under these Terms. We may change, pause or discontinue features, including Rival AI, and we do not promise that Rival will always be available or error-free.
12. Ending your use
You can stop using Rival at any time. We may suspend or close an account that breaks these Terms or creates risk for Rival or other players. We may also end the service with reasonable notice. Sections that by their nature should continue after closure, such as sections 4, 5, 9 and 13 to 15, still apply.
13. Disclaimers
Rival is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied. This includes accuracy of market data, fitness for a particular purpose and uninterrupted availability. Some jurisdictions do not allow these exclusions, and your mandatory consumer rights are not affected.
14. Limitation of liability
Rival’s games use virtual money only. To the extent the law allows, Rival is not liable for:
- indirect, incidental, special or consequential losses;
- lost profits or data; or
- real-world decisions you make based on anything you saw on Rival.
Our total liability for all claims about Rival is limited to one hundred US dollars. Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
15. Governing law and disputes
These Terms are governed by the laws of Israel. Disputes will be heard by the competent courts of Tel Aviv, Israel. If you are a consumer, you also keep any right to bring claims in the courts where you live, and to the protection of the mandatory laws of your country.
16. Changes to these Terms
We may update these Terms. We will tell you about material changes in the app or by email before they take effect. If you keep using Rival after that, the updated Terms apply. If you do not agree, you can close your account.
